12A and 80G Registration Consultant in Delhi

12A exempts an NGO's surplus income and 80G lets donors claim a deduction. Both are applied for online on the income tax portal, so there is no Delhi office to visit. Form 10A is used for new or provisional registration and Form 10AB for regular registration and renewal. ICP Legal prepares the filing and attaches the correct Delhi registration proof. We serve Delhi from our Noida office.

Key Facts

  • 12A: exemption for the NGO. 80G: deduction for donors.
  • Form 10A: new or provisional registration, valid three years.
  • Form 10AB: regular registration, valid five years, and renewal.
  • Filed online. No government fee.
  • Only for NGOs that are already registered.

What 12A and 80G do

12A means income applied to the NGO's charitable objects is exempt, subject to the law's conditions. 80G helps donors claim a deduction, which makes it easier to raise donations from individuals and companies. Most NGOs apply for both.

Provisional and regular registration

A new NGO applies in Form 10A and receives provisional registration valid for three years. It then applies in Form 10AB for regular registration valid for five years, at least six months before the provisional registration ends. Form 10AB is filed again every five years for renewal.

Which proof a Delhi NGO attaches

The registration proof depends on the form of your NGO.

  • Trust: the registered trust deed from the Delhi Sub-Registrar.
  • Society: the certificate of registration from the Registrar of Societies, Delhi, with the memorandum and rules.
  • Section 8 company: the certificate of incorporation and licence from RoC Delhi-I or Delhi-II.

Mismatched names or addresses across these documents are a common reason for queries, so we reconcile them before filing.

Other documents usually needed

  • PAN of the NGO and details of trustees, members or directors
  • Bank account details
  • Activity details and, for older NGOs, past financial statements
  • Authorisation for the person signing the application

Steps

  1. Log in to the income tax e-filing portal with the NGO's PAN.
  2. Select Form 10A for new or provisional registration, or Form 10AB for regular registration or renewal.
  3. Fill in details and upload documents.
  4. Sign with a digital signature or e-verify.
  5. Respond to any clarification and receive the approval order on the portal.
